Derby Winning Jockey Fined for Excessive Use of the Whip

It was a stretch dual for the ages, leaving horseplayers breathless. With Journalism under Umberto Rispoli making the first move at the top of the stretch, the battle ensued as he was quickly joined by Sovereignty under Junior Alvarado. The two 3-year-old colts battled to the wire on a sloppy Churchill Downs track with Sovereignty pulling away late in the end for a narrow victory. The winner was trained by Hall of Fame trainer Bill Mott.

Bettors were rewarded generously as the winner went off at odds of 9-1, the 4th choice in the field. Journalism was the post-time favorite at 7-2. After drawing in off the also-eligible list, Baeza finished 3rd at odds of 14-1 to complete the trifecta.

This was the first derby win for Alvarado, a top-notch jockey who normally rides the East Coast circuit. While thrilled with the victory, Alvarado would later learn that he was being fined $62k for excessive use of the whip.

About the Fine Ruling

A jockey is expected to give his all to secure the best placing possible for their mount. Failure to persevere can result in a hefty fine. Conversely, the Horse Integrity and Safety Authority (HISA) has rules in place regarding how many times a jockey can persevere by striking a horse with their whip during a race.

During the Kentucky Derby, Alvarado struck Sovereignty eight (8) times in the stretch per the video replay. HISA only permits six (6) strikes, which means Alvarado exceeded the limit by two (2).

Per the guidelines, violating the rule by 1-3 strikes calls for a penalty that is the greater of $250 or 10% of the jockey's part of the purse. The final purse for the Derby was slightly over $5 million with 60% going to the winner. Winning jockeys get 10% of the winning purse, making Alvarodo's share $310,000. At 10%, the normal fine would be $31k. However, it was Alvarado's second fine in 180 days, calling for a doubling of the new fine. He gets hit with $62K.

In an interview, Alvarado took the fine in stride, stating:

"I wasn't galloping by 10 [lengths]. When the extra whip happened, I was right next to the favorite and I needed to do what I needed to do at the time." Alvarado then added, "After [watching a replay], I saw I went over, but I had no time to think about that [in the moment]. I just wanted to win the biggest race in America."

Indeed, winning the Kentucky Derby is the dream of any jockey who ever walked the backstretch. For Junior, the fine would seemingly be a small tradeoff for a chance to enter the history books.

Note: The whip-limit rule was put in place in 2020 in response to a rash of track-related deaths of thoroughbreds. At the time, Churchill Downs was considered one of the deadliest racetracks in America. Things have been improving thanks to the efforts of HISA and cooperation from the horse-racing community.
