New bill in New York will make DFS operations much more difficult

A new bill has been introduced in New York by Assemblyman Dean Murray. This type of proposed law might change the way that the state sees daily fantasy sports operations. The bill will try to change not only the way this type of operators will make things in New York, but also the way the whole country sees daily fantasy sports. Both federal laws and state constitution might go through changes if the bill gets a pass. Assemblyman Dean Murray wants put a ban on daily fantasy sports operations by the state of New York, a job that would be executed by New York Attorney General Eric Schneiderman. Bill AO8587 would make changes on the constitution regarding gambling where the Professional and Amateur Sports Protection Act 1992 (PASPA) would be a very important part; section nine of article one states: “except for fantasy sports wagering on professional sports which may be authorized by the legislature, in a manner prescribed by the legislature for offering and conducting gaming and wagering, provided however, that such authorizations shall be preceded by the elimination of the federal ban on professional sports wagering”. New York by Assemblyman Dean Murray has said: “The bill is a contingency measure; if the courts rule that these sites do constitute gambling, this measure serves as the first step in a constitutional amendment process in granting fantasy sports sites like FanDuel and DraftKings exemptions. I am hopeful that if the courts don’t overturn what is clearly a bad decision from the Attorney General, my legislation will.”

Gary Pretlow from Bonacic has added: “People have found a loophole in gambling and it is called fantasy. We would like to take a closer look and see what regulations, if any are needed. I am hoping to get some insight into the whole working of fantasy sports in general. The attorney general has said it’s gambling, and whether or not it is I do believe there needs to be some strong regulations to protect consumers”. Bonacic has also said: “With the explosive growth of Daily Fantasy Sports in the United States, questions have arisen about their operations. I personally believe that it is a game of skill, and not a game of chance. Daily Fantasy has operated legally for years in NY and is very popular, however it can be highly addictive. As such, consumer protections may be in order. I expect to have discussions with my colleagues on Daily Fantasy Sports when the legislative session convenes in January.”
