Online gambling has opened in several other states, but it remains an illegal activity in the state of Arkansas. The state of Arkansas never changed its laws to open up online gambling. The one exception is online sports betting, which they approved for operation in February 2022.

We must look at how online sports betting represents 90 percent of the activity in other states to understand what a monumental shift this new action will be. While they legalized it in November 2018, it required you to visit one of three physical casinos in the state. Technically, that makes it feel less like online sports betting.

The slow opening of online sports betting may open up other online gambling venues in the state. Over 20 other states passed legislation that legalized sports betting, or they will offer it within the next few years. Part of the reason for the slow opening comes from the resistance of the state government. Arkansas Governor Asa Hutchinson opposes efforts to legalize it.

In the original state constitution, they included an anti-gambling statute which means they will need to create a constitutional amendment to legalize it. Traditional sports betting has remained illegal for a long time, but they have kept fantasy sports betting legal due to them designating it as a game of skill over a game of chance.

Despite a rocky past, we see a future that shows signs of promise as it opens up more and more.
